If you are accessing the 360 System as an authorized end user (“End User”) on behalf of a Optic Systems business customer (“Client”) that has entered into a separate services agreement (“Services Agreement”) with Optic Systems, your use of the Services is at all times subject to the additional terms and conditions set forth in such Services Agreement and our End User License Agreement (“EULA”) which is incorporated by reference, that you can review and access when you log in to the 360 System.

This Privacy Policy applies to Information we collect through the Website, 360 System and other electronic communications sent through or in connection with the Services. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy section below). Information Collected From Our Service Providers, Vendors and Third-Parties

Optic Systems may use contractors, vendors and other third-parties to assist in the provision of our Services and to improve the quality of our Services. Optic Systems uses an outside vendor to create inspection videos taken from public roads and other areas expressly authorized for access by our Clients (“Videos”). These Videos will often capture the front of buildings, landscaping, vegetation, public roadways and other utilities, in accordance with the requests of our Clients. These Videos may in some instances record personal data or information reflected from the environment as in existence on the date the Videos were recorded, such as license plates, images of individuals or mailbox numbers.

These Videos do not capture audio and are only ever taken from the public road, or private areas in which Optic Systems has been granted express authorization to provide services for by specific Clients. These Videos are uploaded to the 360 System and made available to the applicable Client via a restricted access online platform. In some limited instances Clients may create and upload their own Videos to the 360 System. Automatically Gathered Information

Optic Systems automatically tracks certain information about you based upon your behavior while using the Services. This information is used to better understand and serve you by responding to your particular interests and needs.

Usage Details

When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including traffic data, date and time you access the Services, the number of links you click within the Services and any third-party website and sections within the Services that you access.

Device Information

When you access the Services, we may collect information about your device and internet connection, including the device's unique device identifier, IP address, geolocation, operating system, type of mobile device you use, browser type and network information.

Our Services may use cookies to enhance the user experience while using our Services. Information Contained in Videos

Videos captured by the 360 System equipment and uploaded to the 360 System, and derivatives of the foregoing, are reviewed and processed as part of the Services. If you are a private citizen, and you believe you may have been captured in a Video (for instance, your vehicle license plate was recorded, or you believe you were visible in one of the Videos), please contact us at [email protected].

Information Provided at Time of End User Registration or Purchase.

To access and use certain of the Services, you may be required to register a unique username and password, by entering your name, e-mail address, phone number, and mailing address, and other information that assists Optic Systems in providing access to the 360 System and Services purchased by you, or by the Client for which you are acting as an authorized End User. This information is necessary for us to provide you with access to and use of the purchased Services.

Payment Information

If you are a Client, we use third-party payment processors to process your payments. These third parties will collect the information necessary to effectuate your transaction with us, such as credit/debit card number, security/CVV code, and expiration date. Our payment processors may handle your payment information in accordance with their own privacy policies. Optic Systems does not have access to your payment information.

Shipping Information

You may need to provide a mailing addressing if you purchase equipment through the Services. This information is necessary for our third-party shipping vendors to deliver the equipment purchased.

Providing and Promoting our Website and Services and its Security

We process your Personal Information by tracking your use of our Services, creating aggregated non-personal data, verifying accounts and activity, investigating suspicious activity, and enforcing our terms and policies to the extent it is necessary for our legitimate interest in promoting the safety and security of the Services, and in protecting our rights and the rights of others.

We process your Personal Information to analyze trends and to track your usage of and interactions with our Services to the extent it is necessary for our legitimate interest in developing and improving our Services and providing our guests with relevant content and service offerings, or where we seek your consent. We process device and usage data which in some cases may be associated with your Personal Information, to analyze trends and assess and improve the overall user experience to the extent it is necessary for our legitimate interest in developing and improving the services.

Geo-location Information

When you use certain of our Services, we may collect information about approximate location as determined through your IP address, GPS, or nearby devices (Wi-Fi access points, cell towers, etc.) to provide the Services. Where precise geo-location information is collected, it is only collected where an individual has provided affirmative express consent and such individual has chosen to save the location data into the 360 System. This information is retained by Optic Systems in the 360 System, for as long as necessary to deliver the services requested.

Non-Personal Information.

We collect and create de-identified, anonymized and aggregated information and other non-personal information, which is not related to an identified or identifiable natural person (“Non-Personal Information”). You agree that Optic Systems owns, without restriction, all Non-Personal Information and that you have no rights in or to any Non-Personal Information. Because Non-Personal Information cannot be used to personally identify you, you agree we may use such information for any lawful purpose.

For individuals that register as End Users of the 360 System with Optic Systems, pursuant to a separate Services Agreement between Optic Systems and the Client for which the End User is authorized to act, you consent to Optic Systems’ collection and use of the Information provided by you in order to advance Optic Systems’ purposes, including, but not limited to: (a) maintain and service your 360 System accounts; (b) process and fulfill the orders, transactions and request for Services, which includes but is not limited to: (i) processing Client Data; (ii) fulfilling your requests, such as email or mailing violation notices; (iii) generating reports and violation letters; (iv) sharing information by pushing and pulling information with Client’s internal systems and software; (v) reviewing and processing Videos; and (c) provide similar services to you and our other clients (collectively “Business and/or Commercial Purposes”). We may further disclose Client Data with your consent and in accordance with the terms and conditions of the separate services agreement as agreed to between Optic Systems and the applicable Client, in order to provide our Services.

We may disclose your personal information, to other trusted service providers and contractors to provide and improve the Services, facilitate and complete transactions, provide requested services, process payments, ship equipment, verify shipping addresses, analyze use of our Services, perform analytics and produce statistics on the Services, or deliver other requested services and features to you. These service providers and contractors may include, but are not limited to companies that provide mailing services, internet service providers, and mail/parcel delivery service providers.

As a general rule, beyond the uses set forth above that assist us in carrying out Optic Systems’ Business and/or Commercial Purposes, providing the Services requested by you, and as may be agreed to in a separate Services Agreement, we will not sell or share your personal information to third parties without your permission.

As we may determine in our sole discretion, we may disclose personal information if required to do so by applicable law, including, without limitation, responding to a subpoena or request from law enforcement, court, or government agency, or in the good faith belief that such action is necessary to: (i) comply with a legal obligation; (ii) protect or defend our rights, interests or property or that of third parties; (iii) prevent, investigate, or identify possible wrongdoing in connection with the Services; (iv) act in urgent circumstances to protect the personal safety of customers, guests, or the public; or (v) protect against legal liability.

Sensitive Data

Except to the extent precise geo-location data (addressed above) may be considered sensitive information under some state laws, Optic Systems does not collect any sensitive data. Sensitive data refers to data that includes details about race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, or information about health and genetic and biometric data. In addition, Optic Systems does not collect any information about criminal convictions and offences.

Users have the ability to grant consent to allow Optic Systems to access their precise geo-location data. This data is used to create work orders, assets and other records tied to the specific location. Optic System only stores the location data if the user saves such location data to the 360 System. Optic Systems does not independently track or retain user location data. Users can turn off permissions related to tracking through their device at any time.

The Website is not specifically intended or marketed to individuals outside of the United States. While the Website may be accessible outside of the United States, it does not intentionally target or advertise to individuals outside of the United States. If you are visiting the Website from outside the United States, please be aware that Optic Systems is based in the United States and only offers services in the United States. All information we obtain through our Services will be transferred to, processed in, and stored on our servers in the United States and other countries where our service providers operate. Right to Request Anonymization, Blocking, or Deletion of Personal Information.

You have the right to request the deletion of your Personal Information we have collected from you, subject to certain conditions and limitations under the law. Once we receive a request, we will delete (to the extent required by law) the Personal Information we retain about you and direct any service providers to do the same. If we determine that an exception applies, we will inform you of the reason for denying the deletion request. In some cases, deletion may be accomplished through de-identification.

Please understand that if you request us to delete your Personal Information, our subsequent removal of such Personal Information may impact your ability to use our Services, and may limit your use of or participation in our Services that require your Personal Information.

Right to Revoke Consent.

Where we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time with future effect. Depending on where you are located, you may also have the right to request deletion of Personal Information that was processed based on your consent, or the right to know the consequences of revoking your consent. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.

Right to Object to Automated Decision-Making/Profiling.

You may have the right to object to our processing of your Personal Information, under certain conditions, and we can be required to no longer process your Personal Information. Such right to object may apply if we collect and process your Personal Information through automated decision making, such as profiling, to better understand your interests in our products and services or for direct marketing. If you have a right to object and you exercise this right, your Personal Information will no longer be processed by us for such purposes. Such a right to object may, in particular, not exist if the processing of your Personal Information is necessary to take steps prior to entering into a contract or to perform a contract already concluded.

Right to Opt-out of the Sale of Personal Information.

We do not sell your Personal Information in exchange for monetary consideration. If this changes, we will notify you, and you may have the right to restrict such sales.

Right to Opt-out of Sharing of Personal Information for Certain Processing (Profiling/Targeted Advertising).

Consistent with applicable law, you may have the right to opt-out of having your Personal Information shared for purposes of targeted advertising. You may also have the right to request further information about the disclosure of your Personal Information for those third parties' marketing purposes, such as the contact information of those parties, once per calendar year. We do not currently share your Personal Information for such purposes. If this changes, we will notify you, and you may have the right to restrict such sharing.

Right to Limit the Use and Disclosure of Sensitive Personal Information.

We will only use sensitive or special Personal Information as needed for the purposes for which it was collected or with your consent. We do not currently process sensitive Personal Information for purposes that may be limited under applicable law. If this changes, we will notify you, and you may have the right to opt-in to the processing of such sensitive Personal Information.

Right to Non-discrimination for Exercising a Privacy Right.

We will not discriminate against you for exercising any rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality of goods.

Right to Disclosure of Direct Marketers.

You may have a right to the categories and names/addresses of third parties that have received Personal Information for their direct marketing purposes upon simple request, and free of charge, if any.

Exercising your Rights; Verification of Requests

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. Certain states require that we verify the identity of each person who makes a request to know what Personal Information we have about you or to delete the Personal Information we have about you.

In some regions you may request this information no more than two times in a rolling twelve-month period. When you make this request, the information provided may be limited to Personal Information we collected about you in the previous 12 months.

All requests must provide sufficient information to allow us to reasonably verify you are the person whom we collected Personal Information about or an authorized representative of such person. We will respond to your verifiable request within the prescribed timelines. We will only use the information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Please describe your request with sufficient detail to allow us to properly respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Appeals

If we deny your verifiable request to exercise your applicable privacy rights on your behalf, in some locations you may have the right to appeal our decision. To initiate an appeal, please submit a written request to us within thirty (30) days of receiving our denial notice. We will review your appeal and respond within thirty (30) days of receipt of your appeal. If your appeal is denied, we will provide an explanation for the denial and inform you of any further rights you may have.

De-Identification

Consistent with applicable law, we commit to maintain and use anonymized information in de-identified form and not to attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether its de-identification processes satisfy the requirements of the California Privacy Rights Act, or other applicable state laws.

Do-Not-Track Disclosures; Third-Party Tracking

Certain mechanisms may allow you to send web browser signals, known as “Do Not Track” (“DNT”) signals, indicating your choice to disable tracking on websites. We do not respond to browsers do not track signals currently. We may not be aware of or able to honor and respond to every such mechanism. More information about “do not track” is available at www.allaboutdnt.org concerning such information.

Third parties, other than our service providers and vendors, do not have authorization from us to track which websites, or other online services you visit prior to and after visiting our websites. Please note, however, that we cannot control third-party tracking and there may be some third-party tracking that occurs without our consent or knowledge.

Shine the Light Request

California Civil Code § 1798.83 permits residents of California to request from Optic Systems a notice disclosing: (1) the categories of Personal Information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year, and (2) the names and addresses of those third parties. CHANGES TO OUR PRIVACY POLICY:

We reserve the right to change the terms of this Privacy Policy at any time by posting those changes to this Privacy Policy, so that you are always aware of our processes related to collection, use and disclosure of your personal information. For significant changes, we will notify you by posting a prominent notice on our Website indicating when the Privacy Policy was most recently updated. Please consult this portion of the Website regularly for important changes to the Privacy Policy as they occur.
